Therefore, the City agrees that there shall be no discrimination, interference, restraint, coercion, <br />or reprisal by the City against any employee because of union membership or because of any <br />lawful activity in an official capacity on behalf of the Union. The Union recognizeds the right of <br />all employees and all applicants for employment to be free to join or not to join the Union. <br />Section 3. All of the employees of the City within the bargaining unit shall receive <br />equitable treatment and share in any and all benefits provided herein. <br />ARTICLE 4- CHECK-OFFIFAIRSHARE FEE <br />Section 1. The City shall deduct the initiation fee and regular monthly dues from the pay <br />of employees covered by this Agreement upon receipt from the Union of individual written <br />authorization cards voluntarily executed by an employee for that purpose and bearing his <br />signature, provided that any employee shall have the right to revoke such authorization during <br />any thirty (30) to forty-five (45) day period prior to the expiration of any collective bargaining <br />agreement by giving written notice to the union with proof of service pursuant to ORC Section <br />4117. <br />Section 2. Deductions under this Article 4 shall be made during the second pay period of <br />each month, but if an employee's pay for that period is insufficient to cover Union dues, the City <br />will make a deduction from the pay earned during the next period or a subsequent period. All <br />deductions under this Article, accompanied by an alphabetical list of all employees for whom <br />deductions have been made, shall be transmitted to the Union no later than the fifteenth (15) <br />day following the end of the pay period in which the deduction is made, and upon receipt, the <br />Union shall assume full responsibility for the disposition of all funds deducted. <br />Section 3. The Union will indemnify and save the City harmless from any action growing <br />out of deductions hereunder and commenced by an employee against the City or the City and <br />the Union jointly. <br />Section 4. All bargaining unit employees who are not members of the Union shall pay a <br />fair share fee to the Union in the amount certified by the Union as being properly chargeable as <br />a fair share fee.
