9.4 An Employee that has been suspended and/or dischazged and chooses to file a Grievance, shall be <br />permitted to, at his option, be ailowed to call witnesses to present testimony relating to ihe <br />suspension and/or discharge at the heazing. The Employer shall also be permitted to call witnesses <br />to provide testimony relative to the suspension and/or discharge. Witness lists estabiished by the <br />City or the Grievant shall be exchanged 5 days prior to the hearing. No ather witnesses shail be <br />pecmitted to testify unless so listed, or unless agreed upon by both parties, or unless calied by <br />either party as a rcbuttal witness. <br />9.5 Failure of an Employee to comply with the provisions of this Article and the provisions contained <br />within Article VII of this Agreement shalt result in immediate forfeiture of further right of appeal. <br />9.6 Failure of the Employer to comply with the provision contained in Section 9.2 above shalt result in <br />rendering the suspension and/or termination null and void. <br />9.7 The rime limits set forth within the Grievance Procedure (Article VII) may be modified by written <br />mutual agreement of the Association and the Employer. <br />9.8 The Employer shall aotify the Association in writing of each disciplinary aciion invotving <br />suspension or discharge. <br />9.9 The Empioyer shall make every attempt to notify an Association representative in the event of any <br />written discipline, suspension or dischazge before the action is taken. <br />ARTICLE X <br />OVERTIME <br />10.1 The Fire Chief will be the final authority in determining the need for Overtime. <br />10.2 Overtime shall be paid in one-half hour increments. With respect to Overtime and Cail Back, <br />Employee's may be required to stay the entire time if in the discretion of the Officer in Charge the <br />saine is necessary. Employees shall receive a minimum of overtime compensation as listed below: <br />Holdover - Minimum'h Hour <br />Callback - Minimum of 2 Hours <br />18
