his separation from service then the sick leave bank shall be credited from his separation <br />check. Such requirement of repayment may be waive by a majority vote of the Executive <br />Boazd of Loeal 1267, the Chief and Assistant Chief. <br />14.9 The Employer may cequire any Employee requesting paid sick leave to furnish substantiating <br />evidence or a statement from his/her attending physician certifying that absence from work was <br />required due to one of the reasons set forth in 14.5. Such certification must be presented whenever <br />sick leave is requested for more than rivo (2) consecutive tours of duty for Employees who work <br />an average of 50.4 hours per week and for five (5) consecutive woricing days for Employees on a <br />forty (40) hour work week. <br />ARTICLE XV <br />LEAVE OF ABSENCE <br />15.1 In addition to medical Ieaves to which they may be entitled to under the Family Medical Leave <br />Act ("FMLA"), Employees shall be entitled to take a personal leave of absence with the approval <br />of the Fire Chief. Any leave of absence for personal reasons shall not exceed a ninety day period. <br />If the personal leave of absence is for an event which qualifies for medical leave under FMLA, <br />then the City may require the employee to take the leave as medical leave under the FMLA. <br />15.2 To maintain any benefits norrnaily paid by the Employer, the Empioyee on a personal leave of <br />absence as provided for in Article 15.1 or on a medical teave under FMLA, shall pay the cost of <br />such benefits to the Finance Director on the first day of the month for which the benefit payment <br />applies, pravided, however, thai employees on quaiifying medical leaves under FMLA shail not be <br />required to pay the City's share of their health insurance premium while on such qualifying <br />medicai leave. <br />15.3 If an Employee does not report to the Fire Chief upan expiration of any leave of absence, he shall <br />lose all rights of employment. <br />15.4 Probationary Employees shall not be eligible for a Personal Leave of Absence. <br />15.5 Employees on qualifying military Ieaves of absence are entitled to receive all benefits guaranteed <br />under applicable federai law and local ordinance to employees who aze on snch leaves of absenee, <br />but are not entitied to any benefits guaranteed to municipal employees on military leaves of <br />28
