absence by state law, so long as the City, by local ordinance or in collective bargaining <br />agreements, provides benefits for such employees that vary from state law <br />ARTICLE XVI <br />WORK RE ATED ILLNESS/IN3URY <br />16.1 The parties hereto recognize and agree that the duties of the Employee of the Division of Fire are <br />such that said Employses are exposed to disease and injury as a result of their assigned duties. It <br />is the intention of the parties to provide to said Employees, salary continuation benefits when an <br />Employee conttacts an iliness as hereinafter specified. Likewise, it is the intention of the parties to <br />provide to said Employee, salary continuation benefits when an Employee is injured while <br />responding to an emergency call, returning from an emergency call, aperating at or during an <br />emergency call or training that replicates emergency situations. It is not intended that salary <br />continuation benefits be granted to emplayees who incur routine injuries in the performance of <br />their duties in non-emergency situations. <br />16.1(a) In the event that a full time sworn Employee of The North Oimsted Fire Department <br />should become ill due to contact with AIDS, Hepatitis, Tuberculosis, or Meningitis, and such <br />illness has so incapacitated the Employee that he temporarily is unable ta work, the Fire Chief <br />shall investigate and determine whether the itlness is work related and of a temporary nature. The <br />Fire Chief shall then forward his finding to the Safety Director who shall determine the nature and <br />extent of the illness and how contracted, including the circumstances thereof. If after <br />consideration of the totality of the facts, the Safety Director determines that said disease was <br />contracted during emplayment and is of a temporary nature requiring medical leave, the Safety <br />Director may authorize the full payment of the employees regular salary for a period of ninety <br />days. <br />16.1(b) If an Employee is injured while engaged in an emergency response, an injury <br />investigation shall be conducted by the Injury Investigation Committee (The Fire Chief, an <br />individual chosen by the Union and one individual designated by the Safety Director). Said <br />Committee shall investigate the facts and circumstances surrounding said injury and forward a <br />report to the Safety Director. The Safety Director shall determine if the injury is work related and <br />of a temporary nature. The Safety Direcior shall alsn determine the nature and extent of the injury <br />and the cause thereof, including the surrounding circumstances. If after consideration of the <br />29
