22.7 At the request of either party, interviews, or portions thereof with an officer, <br />conducted during the course of an inquiry may be tape recorded (audio). In the case of an interna.l <br />investigation, such interrogation shall be recorded by the police department at the request of either <br />party. A copy of the tape will be made available to the Union. <br />22.8 If any officer believes any portion of these rights have been violated, the violation <br />shall be noted and may be presented to the person or the court that will be making judgement on <br />the case tha.t is presented. <br />ARTICLE 23 <br />LAYOFF/RECALL <br />23.1 When a layoff is necessary due to lack of funds or lack of work, the Employer shall <br />notify the affected employees in writing at least thirty (30) days in advance of the effective date of <br />layoff. <br />23.2 The employee with the least departmental seniority will be the first laid off., <br />23.3 Bargaining unit members shall remain on a lay off list for four (4) years as long as <br />the member maintains his or her certification. The City shall recall from that list in the reverse <br />order in which the members were laid off before hiring anyone else. <br />23.4 Notice of recall sha11 be sent to the employee(s) by registered mail, with a copy to the <br />FOP/OLCI, and shall contain a date to return to work which shall not be less than thirty (30) days <br />from the date of mailing. The Employer shall be deemed to have fulfilled its obligation by mailing <br />the recall notice by registered mail. The notification of the intent to return to work must be <br />communicated to the Chief of Police within fourteen (14) days of receipt of notice as aforesaid, <br />and the employee must report back to work by the date set forth in the notice or forfeit his or her <br />right to return. <br />39
