ARTICLE 27 <br />COMMiJNICABLE DISEASES <br />27.1 The parties hereto agree that the duties of the employee of the Division of Police <br />are such that said employees are exposed to disease as a result of their assigned duties. It is the <br />intention of the parties to provide to said employees, salary continuation benefits when an <br />employee contracts an illness as herein after specified. <br />27.2 In the event that a full-time employee of the bargaining unit should become ill due <br />to contact with AIDS, HIV, Hepatitis, Tuberculosis or Meningitis and such illness has so <br />incapacitated the employee tha.t he temporarily is unable to work, the Police Chief shall <br />investigate and determine whether the illness is work related and of a temporary nature. The <br />Poiice Chzef shall then forward his finding to the Safety Director who shall determine the nature <br />and extent of the iliness and how contracted, including circumstances thereof. If after <br />consideration of the totality of the facts the Safety Director determines that said disease was <br />contracted during employment and is of a temporary nature requiring medical leave, the Safety <br />Director shail authorize the full payment of the employees' regular salary for a period of ninety <br />(90) days. <br />27.3 If after ninety (90) days an iliness still temporarily incapacitates the employee, the <br />Safety Director sha.ll recommend to Council whether to continue salary. Council shall forthwith <br />review the matter and by a majority vote determine whether the employee shall continue to <br />receive fuli salary during recuperation. <br />27.4 Any bargaining unit member who qualifies for benefits under this section sliall be <br />required to pay over to the City any amount received from the Bureau of Workers' Compensation <br />as supplemental wages. Further if at any time the City determines on the basis of inedical <br />38
