The sale of books, magazines, newspapers, tobacco products, drugs, flowers, gifts, <br />music, photographic <br />equipment and goods, sporting goods or stationery; <br />C. The sale of food, soft drinks, juices, ice cream, but excluding: <br />1. Places serving spirituous, vinous or malt beverages for consumption on the premises; <br />2. Any place providing dancing or entertainment. <br />D. Service establishments for local or neighborhood needs, but limited to barber shops, <br />beauty shops, custom tailors, <br />laundry or dry cleaning agencies where none of the processing is done on the premises, <br />self-service laundries and <br />dry cleaning or shoe repair shops. <br />E. Any other local retail use which the Commission determines will primarily serve the <br />needs of the residents or office <br />tenants of the Mixed Use District and which will not have an adverse impact upon the <br />district's real property values, <br />aesthetics or vehicular traffic patterns. <br />(e) Any land within the City zoned Mixed Use District A before the adoption of this <br />Zoning Code shall remain designated Mixed Use District A. Further, any land zoned <br />Mixed Use District B prior to the adoption of this Zoning Code, sha11 be hereinafter <br />designated Mixed Use District C. <br />1149.041 DEVELOPMENT REGULATIONS FOR MIXED USE DISTRICT D. <br />(a) To the extent applicable and not inconsistent with other regulations set forth herein, <br />the development regulations set forth in Section 1149.04, for Mxed Use Districts A, B <br />and C, sha11 also govern development in Mixed Use District D. <br />(b) Development Area. "Development area" in Mixed Use District D shall be construed to <br />mean a parcel or parcels of land, meeting the minimum size requirement of Section <br />1149.02, under common ownership, and for which development is sought. <br />(c) Setback. Each building within a development area shall be located at least seventy-five <br />feet from every abutting street line and Residential District zone line. The Planning <br />Commission may alter these general setback requirements: <br />(1) If the developer provides sufficient additional green area within the development area; <br />or <br />(2) If a lesser or greater setback would be appropriate in order to lessen the impact of a <br />proposed development upon a <br />nearby neighborhood. <br />(d) Height.
