<br />Ordinance No. 2002-100 <br />Page 2 <br />That Article III, Section 5(a) of the Charter be amended by eliminating the existing <br />requirement that the Mayor obtain the concurrence of two-thirds of the members of Council prior to <br />removing from office the Director of Public Service, the Director of Public Safety, the Director of <br />Human Resources, or the head of any other City department or division created by the Charter and <br />appointed by the Mayor, so that, as amended, this pazagraph (a) of Section 5 of Article III shall read <br />as follows: <br />"Article III <br />THE MAYOR <br />SEC. 5. DUTIES AND POWERS OF THE MAYOR. <br />(a) Executive Powers. The Mayor shall be the chief executive officer of the City. He sha11 <br />supervise the administration of the City's affairs and sha11 exercise control over all departments and <br />divisions. He sha11 be the chief conservator of the peace within the City and shall cause all laws and <br />ordinances to be enforced. He sha11 be responsible for the preparation and submission of the annual <br />estimate of receipts and expenditures, and of appropriation measures, and sha11 at all times keep the <br />Council fully advised as to the financial condition and needs of the City. He shall cause all terms and <br />conditions imposed in favor of the City or its inhabitants in any franchise or contract to which the City <br />is a party to be faithfully kept and performed. <br />Except as may otherwise be provided by this Charter or the laws of the State of Ohio <br />governing Civil Service, the Mayor sha11 have the power to appoint, promote, transfer, reduce or <br />remove any officer or employee of the City except (a), those required by this Charter to be elected, <br />and (b), those whose terms of office may be fixed by this Charter. The appointment of every officer <br />and employee appointed by the Mayor sha11, unless othervvise provided in this Charter, automatically <br />ternunate at the earlier of (1) the end of the term of office of the Mayor making the appointment, or <br />(2) the date upon which the Mayor making the appointment leaves office by death, resignation or <br />other reason creating a vacancy in the office of Mayor. Unless otherwise provided for in this Charter, <br />the Mayor may during his term remove any officer or employee whom he has appointed. <br />The Mayor sha11 execute on behalf of the City, all contracts, conveyances, evidences of <br />indebtedness, and all other instrumerns to which the City is a party. He shall have custody of the seal <br />of the City and may affix it to a11 of said instruments, but the absence of the seal sha11 not affect the <br />validity of any such instrument. The Mayor sha11 be recognized as the official and ceremonial head <br />of the CiTy government by the Governor for military purposes and by the courts for the purpose of <br />serving civil processes." <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting therean, then the said amendment to Article III, Section 5(a), of the Charter shall <br />be effective as of the earliest date provided by law. <br />2
