^ J ?'•'?J=-•?o?_ -. ? ?' ?:,L SECTION III - SCOPE OF WORK Attachment One, hereby incorporated into this Agreement in its entirety, shall constitute a complete and detailed description of the PROJECT with respect to the scope and intent of the transportati4n irnprovement(s) to be constructecl. Seciion V details the categories of zelevant development activities and their costs, and the specific sources and status of funds to be made available xor their accomplishment. SECTIaN N - GENERAL REQUIREMENTS The I.PA shall designate a fully qualified prnfessianal engineer to act as Project Engineer and serve as the LPA's grinciple rcpresentative for the PROJECT. Detailed desi gn, preparation of construction plans and specifications, and other development activities for the PROJECT shall be perforrned by or under the close direction of thc Project Engineer. lle LPA shall camply with all applicable State laws, regulations, and executive orders. This obligation is in addition to compliance with any law, regulation or executive order specifically referenced in °s Agreement. SECTION V- COST SHARTNG AND LISF OF FtNnc FnR THE 03ECT As set farth in Attaclunent One hereto, the total eligible cost for the PROJECT is estimated to be Une Million Four Hundred Ninety Thousand Dollars ($1,490,000). Funds provided through ODOT shall be applied only to the eligible eosts associated with ttze actuat construction of the PRQJEGT and construction engineering/inspection activities. The costs ofpreliminarydevelaprnent, final anginoering design, the acquisition of right of way, and general administration are not eligible for funding under this Agreement. Fmm the State Highway funds raade available for these pucposes by the Director, ODOT shall provide the LPA with eligible costs associated with these agproved categories at a rate of Eighty Percent (80%), up to a maximum of One Milleoa One Hundred Ninety-iwa Thonsasd Dollars ($1,192,000). Thimaximtun Sta.te smount reflects the ftmding limit for the PROJECT set by the Program Manager. The LPA shall provide all other financial resources necessary to fully complete the PROJECT, inclusive of cost overruns and contractor claims. ' SECTFON Va - ADA COMP?,TANCE As part af the PROJECT, the LPA shall install andlor repair all curb ramps which aze necessary to ensure carnpliance with the Americans with Disabilities Act and the LPA agrees to assume and bear one hundred percent (100%) of the cost af such installation and/or repair of curb ramps.
