• . ,_:.5?_..=?5"' -,'?r,i'.? <br /> <br />a-? <br />be performed in cainpliance with 23 CFR Part 645 and the ODOT Utilities Manual. <br />All aerivities pertaining to the acquisition af right of way for tbe PRC)3ECT shall be performed by <br />either ODOT real estate staff, or by fully qualified LPA staffthat have been prequalified by ODOT, <br />or third-party professionals experienced in the requirements of the Uniform Act and who have been <br />prequalified by ODpT. Formal appraisals shall be perfarmed by ODOT staff appraisers, LPA staff <br />appraisers that have been prequa.lified by ODOT, or by licensed appraisers who possess the <br />appmpriate Ievel of pmfessional certification from the Ohio Department of Commerce and who are <br />experienced in the requirements of the Uniform Act and have been prequalified by ODOT. <br />Likewise, the appraisal review function must be performed by ODOT, by LPA review appraisers <br />that have been prequaiified by ODQT, orby fee review appraisers who are certified and prequalified <br />by ODOT. <br />In the event that the LPA and/or its consultants perform the necessary real estate services, the LPA <br />slWl provide the ODOT District Office wiith its ccrtification that all rigtrt of way property rights <br />necessary for the PROJECT are under the LPA's control, that such right of way has been cleared of <br />all eneroachments, and that utility facilities have been appro <br />priately relocated at accounted for so <br />as not to interfere with PRQJECT construction activities. ODOT shall make usc of the LPA's Right <br />af Way Certification, as well as evaluate the LPA's uid/or consultant's performance of tlie <br />PROJECT reat estate activities under Titles II and TII of the Uniform Act. <br />The i.PA agrees that all subsequent modifications to the design of the PROJECT andJor any disposal <br />of property rights acquired as part of the PR07ECT will be subject to the approval of ODOT. <br />SECTION X- PLANS, SgECIFICATTONS, and ESTIMATE <br />All architecturaUeagineeringplans $nd designs, specifications, estimates ofmaterial quarrtities, and <br />any other documents necessary to advertise the PROTECT for competitive bidding and construction, <br />shaIl be signed and sealed by a fullyqnalified licensed professional engineer. Construction materials <br />specifications €or the PROJECT shall include the "Steel Madc ia the United States" provision <br />pursuant to Sections 153.0I 1 and 5525.21 of the Ohio Revised. Code. The LPA shall provide to <br />ODOT no less than 30 days prior to a scheduled bid ogening date, a camplete Plan Submittal <br />Package consisting of at least the following: PROJECT plans and specifications; the Project <br />Engineer's detailed conshvcrion cost estimate; a copy of this Agreement; a completeti Plan Package <br />Submittal Form; an Envimaaiental Cansultation Form demonstrating continuing sufficicncy af the <br />PROJECT's environrnental clearance activities, including historic preservation requirements, <br />vnfulfilled imgact mitigation commitnients, and issuance of any required permits; and a R.ight af <br />Way Certification. <br />Psge 4 <br />
