2165818650 P.07i14 <br />SECTION XI - COMPETITIVE BIDDING <br />If applicable, upon approval of thc Plan Package Submittal by the Qffice of Project Caordination, <br />the LPA shall advertise the PROJECT for two weeics, competitively bid the PR07ECT, and award <br />the contract in aeeordance with Section 735.05 of the Ohio Revised Code. Zn the event the lowest <br />and best hid is in excess of the afficial eonstruction cost estimate, coneurrence frvm the Program <br />Manager must be secured prior to the award of a construction contract. <br />SECTION XII - CONSTRUCTION BONDS AND INSURANCE OF C4NTRACTOR <br />The LPA shall require that the selected eantractor provide a performance bond and a separate <br />paymcnt bond in the full amount of the LPA' s official construction cost estimate. The LPA and <br />ODOT shall both be named as an obligees on fhe bonds. The LPA shall also requue that the selected <br />contractor have and maintasn a commereial and generalliability insurance pnlicy with miniiniun <br />coverage amounts of $500,000 per occurrence. <br />SECTION MTI - CONSTRUCTION SUPERVISION <br />The work of the construction contractar shall be porfarmed under the generai supervision and <br />direction of the Projeet Engineer who shall provide or provide for inspection activities sufficient to <br />assure the contractor's comptiance with aIl applicable canstruction standards and material <br />specifications required for the PROJECT. The LPA shall certify both the quaatity and quality of <br />material used, the quality of the work performed, and tho amount of construction engineering cost <br />incun-ed by the LPA for the eligible work an the PROJECT. <br />SECTIQN XIV - PAYMENT OF PRQJECT_INVOICES <br />The LPA sliall review/prepare invoices far wor3c performed on the PROJECT and ensure their <br />aGCUracy in both amount and in relation to the progress made on the PROJECT. The LPA may <br />periodically submit to ODUT a written request for either current payment or reimbursernent of the <br />State share of the expenses iavolued, attaching copies af all source documentation associated with <br />pending invoices ar paid costs. ODOT shall pay or reimburse the LPA far the eligibtc itcros of <br />expense in accordance with the cost sbaring provisions of Scction V of this Agreement <br />Each request for payment or reimbursement submitted by the LPA shall conform in aIl respects ta <br />applicable State of Ohio billing requirements and procedures. ODOT shall pay each approved <br />request for payment or reimbursement within thirty calcndaz days after its receipt of a proper invoi ee. <br />Within thirty days after completion of aIl work under this Agreement, the LPA sbaIl submit to <br />ODOT a detailed final request for reimbursement, based on work order accounting covering the <br />actual costs of work performed. Information as to the location of PROJECT reeords showing where <br />accot€nts may be audited shall also he provided. <br />Page 5 <br />
