Over, District Construction Enginesr <br />SECTTON XV - MATNTENANCE OF TAE PRUJECT <br />2165518650 P.08i14 <br />After comgfetion of the PRQJECT and in accordancb with the applicable provisions of the Ohio <br />Revised Code, the LPA shall provide adequate maintenance activities for the improved <br />transportation facility. <br />SECTION XVI - CERTIFICATION OF FLJNDS <br />It is unders#oad by the pazties that none of the rights, duties and obligations described in this <br />Agreement shall be binding on either party until all statutory provisions of the Ohio Revised Code, <br />including but not limited to Section 126.07 have been complied with and until such time as alI <br />necessary funds are made available and forthcoming from the appropriate State agencies, and, if <br />necessary, snch expenditure vf funds is approved by the Controlling Board of the State of 0hio. <br />SECTION XV,TI - RECAPTURE OF FUNDS <br />Unless otherwise directed by ODOT, if, for any reason, the PROJECT is not completed 'm its entirety <br />or to a degree acceptable to ODOT, ttie LPA shall repay to ODOT an amount equal to the total funds <br />ODOT disbursed in behalf of the PROJECT. <br />SEC1'IQN XVIII - RECORD RETENTION <br />The LPA, when requested at n.asanable times and in reasonable manner, shall rneke available to the <br />agents, officers, and auditors of ODOT and the United States government, its books, documents, and <br />records rela#ing to the LPA's obligatians under this Agreement All sucli books, documcnts, and <br />records shall be kept for a period of at Ieast three yeazs after ODOT approves the LPA's final request <br />for reimbursement of PR07ECT expcnses. In the event that aa audit-related disgutc shoulc3 arise <br />during this retention period, any such boaks, documents, and records that are related to the disputed <br />matter shall be preserved for the term of that dispute. <br />The LPA shall require that atl contracts and other agreements it enters into for the performance of <br />the PROJECT contain the folIowing specific Ianguage: <br />As the LPA, ODOT or the United States gavenzment may legitimately request from <br />Page 6 <br />
