Limpert, D'uector of Public Services <br />January 14, 2008 <br />Page 5 of 10 <br />instructions to the CONTRACTOR(s) shaYl be issued through ATS who will have <br />authority to act on behalf of City to the extent provided in said Standard General <br />Conditions except as otherwise provided in writing. <br />1.4.2 ATS shall make visits to the site as appropriate to the various stages of <br />construction in order to observe the progress and quality of the CONTRACTOR's <br />work to determine if CONTRACTOR's work is proceeding in accordance with the <br />Construction Documents. <br />1.4.3 ATS shall not supervise, direct, or have control over the CONTRACTOR's work <br />nor shall ATS have responsibiliry for the means, methods, techniques, sequences, <br />or procedures of construction selected by the GONTRACTOR to comply with <br />laws, rules, regulations, ordinances, codes, or orders applicable to <br />CONTRACTOR's fixrnishing and perfornung the work. Accordingly, ATS can <br />neither guarantee the performance of the CONTRACTOR's work nor assume the <br />responsibility far CONTRACTOR's failure to furnish and perform the work in <br />accordance with the Contract Documents. <br />1.4.4 ATS may disapprove or reject CONTRACTOR's work on the basis of <br />observations while work is in progress if ATS believes that sueh work will not <br />produce a completed Project that conforms to the Contract Documents or that it <br />will prejudice the integrity of the design concept of the Project as refleeted ain the_ <br />Contract .Documents. <br />, • _ . <br />1.4.5 ATS shall issue necessary interpretations and clarifieations of the Contract <br />Documents and in connection therewith prepare field orders and change orders as <br />required. <br />1.4.6 ATS shall review and take appropriate action with regard to shop drawings, <br />samples, operation and maintenance information, and other data which <br />CONTRACTOR is required to submit, but only for conformance with the design <br />concept of the Project and complianee with the information given in the Contract <br />Documents. Such reviews shall not extend to means, methods, techniques, <br />sequences, or procedures of construction or to safety precautions and programs <br />incident thereto. <br />1.4.7 ATS shall evaluate and detertnine the acceptability of substitute materials and <br />equipment proposed bythe CONTRACTOR. ATS will not be responsible for <br />services in making revisions to drawings and specifications occasioned by the <br />acceptance of substitutions proposed by the CONTRACTOR. <br />1.4.8 ATS shall have authority, as CITY's representative, to require special inspection <br />or testing of the work, and shall receive and review all certificates of inspections, <br />
