Limpert, Director of Public Services <br />January 14, 2008 <br />Page 6 of 10 <br />testings and approvals required by laws, rules, regulations, ordinances, codes, <br />orders, or the Contract Documents. <br />1.4.9 ATS shall act as initial interpreter of the requirements of the Contract Documents <br />and judge the acceptability of the work thereunder and make decisions on all <br />claims of OWNER and CONTRACTOR relating to the acceptability of the work <br />or the interpretation of the requirements of the Contract Documents perta.ining to <br />the execution and progress of the work. ATS shall not be liable for the results of <br />any such interpretation or decisions rendered in good faith. <br />1.4.10 ATS shall review and recommend payment of CONTRACTOR's periodic <br />application for payment. Recommendation shall be based on visits to the site, <br />information provided by Resident Project Representative, Contract Documents <br />and previous applications for payment. Recommendation will constitute a <br />representation to CITY that the work has progressed to the point indicated, and <br />that, to the best of ATS's knowledge, information and belief, the quality of such <br />work is generally in accordance with the Contract Documents. The preparation <br />and assembly of the CONTRACTOR's application for payment shall be the <br />responsibility of the CONTRACTOR. <br />1.4.11 ATS shall conduct an inspection to determine if the work is substantially <br />complete. If work is found to be substantially complete, ATS will submit written <br />notification to City and issue Certificate of Substantial Completion to - <br />CONTRACTOR. <br />1.4.12 ATS shall provide written notification to City and issue Certificate of Final <br />Completion to CONTRACTOR upon satisfactory fmal inspection to determine if <br />work is acceptable. Final payment to CONTRACTOR will be contingent on <br />satisfactory fmal inspection. <br />1.4.13 ATS shall provide one (1) set of reproducible and two (2) blueline copies and one <br />electronic copy of "as-built" drawings. Drawings shall be based on information <br />provided by the CONTRACTOR, obtained and reviewed by the Resident Project <br />Representative during construction. <br />1.5 RESIDENT PROJECT REPRESENTATION SERVICES <br />1.5.1 ATS shall provide the services of a qualified Resident Project Representative <br />(RPR) to assist City in the daily observation of CONTRACTOR's work. The <br />RPR will be billed on a time and material basis. <br />1.5.2 The RPR shall observe the work of the CONTRACTOR and report to Engineer. <br />
