Step 2. A grievance unresolved at Step 1 may be submitted by the grievant to the Chief of <br />Police, or his designee, within five (5) working days from receipt of the Step 1 answer. It shall be <br />the responsibility of the Chief of Palice, or his designee, to investigate the matter, hold such <br />hearings as necessary, and to provide a written response to the grievant within the (10) working <br />days, of receipt of the grievance. The grievant ma.y, at his option, be represented by a <br />representaxive of the F.O.P. at any hearing or hearings held at this level. <br />Step 3. A grievance unresolved at Step 2 may be submitted by the grievant to the Safety <br />Director, or his designee, within five (5) working days of receipt of the Step 2 answer. The Safety <br />Director, or his designee, may meet with the grievant and a representa.tive of the F.O.P. if the <br />employee desires, within seven (7) calendar days of submission of the grievance to Step 3, to <br />discuss the grievance. The Safety Director, or his designee, sha11 provide a written response to the <br />grievant within five (5) calendar days of such meeting. Grievances unresolved at Step 3 may be <br />submitted to arbitration upon request of the F.O.P. in accordance with the provisions of Section <br />16.6 of the Article <br />16.6 The F.O.P., based upon the facts presented, has the right to decide whether to <br />arbitrate a grievance. Within ten (10) calendar days from the date of the final answer on a <br />grievance from Step 3, the F.O.P. shall notify? the Employer, in wriiing, of its intent to seek <br />arbitration of an unresolved grievance. <br />The parties sha11 attempt to draft an agreed upon submission staternent. If the parties are <br />unable to agree upon a submission statement, the arbitrator shall frame the issue or issues to be <br />decided. <br /> <br />25 <br />I
