The Employer's representative shail notify the F.O.P. of ariy questions of arbitrability, and <br />of its intent to raise the question at the azbitration hearing. <br />After receipt of a request to arbitrate, a representative of each parly (F.O.P. and Employer) <br />shall attempt to agree on an arbitrator. Should the representatives fail to agree on an arbitrator, the <br />arbitrator shall be selected in the following manner: The Federal Mediation and Conciliation <br />Service (FMCS) shall be jointly requested to submit a panel list af seven (7) arbitrators. The <br />FMCS shall submit a panel-of seven (7) arbitrators. The parties shall alternately strike the names <br />of the arbitrators until only one name remains. Either party may once reject the list and request <br />from the FMCS another list of seven (7) names untii a mutually agreed arbitrator is selected. <br />The arbitrator shall li.mit his decisions slrictly to the interpreta.tzon, application, or <br />enforcement of the specific articles and sections of this agreement, and shall be without power or <br />authority to make any decisions: <br />l. Contrary to or inconsistent with or modifying or varying in any way the terms of this <br />agreement or applicable laws: <br />2. Contrary to, inconsistent with, changing, altering, limiting, or modifying any practiae, <br />policy, rules or regulations, established by the Employer so long as such practice, <br />policy, or regulations do not conflict with this agreement. <br />The arbitrator shall be without authority to recommend any right or relief on an allejet <br />grievance occurring at any time other than the contract perzod in which such right originated or to <br />make any award based on rights arising under any previous agreement, gzievance, or practices. <br />The arbitrator shad not establish any new or different wage rates not negotiated as part of this <br />agreement.
