If NOPEC is not successful, the selccted Suppfier(s) sha1l be resporisible fvr payment <br />of the eustorncr switc.hing fee ta First Energy. <br />2.4.5 Individuai Customer'rerminatiop of Participatiau <br />In add'+tion to the appa:iuruty to vpt-out of the Aggregatian Yrvgrani priar to start up of <br />sarvice, an individual consumer wi14 be given an opportunity to opt-oui at na charge every two <br />years after start up of scrvice. Consumers who move frvrn a member cnmmunity wili havc na <br />penalties ar exit fees. Howevcr, an individual eonsumer who chaoses to opt-out during thc period <br />between start-up and the two year oppartunity ta opt-out may be requircd to pay an exit feE. <br />2.4,6 Servicc Termination by.Supplier <br />Consistent with the requirements of 4hso law and the regulations ot PUCO, termination <br />of servicc may take placc f4r non-payment of bills. Customers whosc power supply is <br />terminated by a seleeted Suppiier wi11 reccive eleccric supply from their local distribution <br />cvmpany, unless the [ocal distnibution cvmpany has also met state requirernents to terminate <br />servicc. C:ustomers may be consi3cred for re-enrollment in the Aggregation Program oncc they <br />hava met ihe requircrnents of law and are current on bill paymicnt. <br />2,4.7 Terminatioa of the NOPEC member Aggregation I'rograrn <br />I'he NOPFC Aggregation Program may be terminated for participating consttmers in two <br />w ays: <br />(1) Upon the tcrrnination or expiratian of the pawec supply contract for all rnember <br />cortununities withoui any extcnsion, renewal, or subsequent supply contract being <br />negotiated; or <br />(2) At the decision of an individual member cons.munity to eancel its membership in <br />NOPEC. <br />In any event of termination, each ind'evidual cusiomer receiving pawer supply scrvices <br />under the Aggregation Program wili recoive notification of tcrmination of the program, ninety <br />(90) days prior to such termination. Custamers who are terminatcd from the Agc?regativn <br />Program sha11 receive power supply from the local distributian campany unless they chaose an <br />altcrnative supplicr. <br />NOPEC shali vtilize appropriate processes for encering, modifying, enforcing, and <br />terminating agrecments pertinent to the Aggregation Progam consistent with the rcquiremen!s of <br />iocal ordinances or resalutions, statc and itderal law.
