<br />landscaping and improvement of the Site and the desidn, construction, furnishing, equippinQ and <br />improvement of the New Building. That schedule shall inctude a timeline and shall identify the <br />party or parties primarily responsible for each activiry. <br />The Tru:stees shall assign the FaciIities Director or his or her designee and the <br />City shall assign the Mayor or his designee, who shall each represent the respective interests of <br />the parties to this A;reement throughout the period of acquisition, preparation, landscapina and <br />improvement of the Site and the construction, fumishin;, equipping and improvement or the <br />New Building. These agents of the parties hereto shaIl oversee aII phases of the project jointly, <br />includincr site acquisition, site inspection, plans review, materials purchase, and all matters <br />related to the project, so as to promote the accompiishment of the purposes of this Ageement. <br />The Library shall not communicate with any trade contractors except through the architect or the <br />construction manager. <br />The parties shall continue their cooperation after completian of the acquisition, <br />preparation, landscaping and improvement of the Site and construction, furnislung, equipping <br />and improvement of tile New Building in pursuing the correction of any defects, challenge of any <br />warranty, actions on performance bonds, prosecution of Iiti?ation and any and all other actions <br />that act to protect the project from fault, harm or defect, then and in the future, at law or in equity. <br />Upon completion of the acquisition, preparation, landscaping and improvement of <br />the Site and construction, fumishing, equipping and improvement of the New Buildin; as <br />contemplated by this Agreement, the parties shall desi;nate individuals from time to time to <br />represent their respective interests during the tenn of the Lease Agreement or any renewai or <br />continuation thereof. <br />-6- <br />t
