3.2 The conduct and grading of civil service examinations, the rating of candidates_ the establishmeiit <br />of eligible lists from the examinations. and the oripnal appointments from the eligble lists are not <br />appropriate subjects for colleciive bargaining. <br />3.3 Unless a public Employer agrees other«ise in a collective bargainiug ageement, nothing in <br />Chapter 4117 of the Revised Code impairs the right and respansibility of each public Employer to: <br />A. Determine matters of inherent managerial policy which include, but are not limited to <br />areas of discretion or policy such as tlze fanctions and prc:_?rams of the pubiic Employer, <br />standards of services, its overall budget, utiliz,ation of tec"\: -logy, and orgaiuzational <br />structure; <br />B. Direct, supervise, evaluate mid lure emplovees; <br />C. Maintain and improve the e.fficiency and effectiveness of governmental operatians; <br />D. Determine the overaU methods, process, means, or persoiinet ty which government:il <br />operations are to be conducted; <br />E. Suspend, discipline, demote, or discharge for just cause, or lay off. transfer, assign, <br />schedule, promote, or retain empio_vees; <br />F. Determine adequacy of die work force; <br />G. Deternune the overall mission of the Employer as a unit of government; <br />H. Effectively manage the work force; <br />1. Take actions to carry out ihe nussion of the public Emplo}ler as a governmental mut. <br />T1ie emptoyer is not required to bargain on subjects reserved to Uie inanagement aiid direction of <br />governmental unit exeept as affect wages, hours, terms and conditions of employ-inent and the <br />continuation, madification, or deletian of an e.r-isting provision of a collective bargaining ageement. A <br />public Employee or exclusive representative mav raise legitimate complaint or file grievance based on the <br />collective bargauung agreement. <br />? <br />6 <br />?
