ARTICLE XXXI <br />IMPASSE PROCEDUR.E <br />31.1 The procedures contained in the Section shall govem the settlement ef disputes between the <br />Employer and the Association concerning the modification af the esistin}; coilective bargainuig <br />agreement or negotiations of a successor agreement. <br />31.2 In the case of either party requesting modification of the current Agreemeiit. the pamr requesting <br />modification shall: <br />A. Serve writien norice upon the other party of ihe proposed modification. The Party must <br />serve notice not iess dhan sixty days prior to the time it is proposed to modify, <br />B. Offer to bargain collectively wzth the other party for the purpose of inedifr•ing the existing <br />Agreement. <br />C. Notify the Staie Emplovment Relations Board of the offer 6y sen-ing upon the board a copy <br />of the w7itten notice to the other party and a copy of the e-astiiig collective bargaining <br />agreement. <br />D. Upon receipt of the notice, the parties shall enter into collective bargaining. <br />E. In the eveat the parties are unable to reach an agreement. the impasse procedure as set forth <br />in Section 4117.14C(2) O.R.C. shall prevail. <br />313 In the case of negotiating a successor collective bargainixig agreement, the party requesting such <br />negotiations shall: <br />A. Serve written notice upon the other party of the proposed successor agreemeni not less than <br />tunetv days prior to the expiration date of die existuig Agreemcnt. <br />B. Offer to bargain collectivelv with the other party for the purpose of negotiating a successor <br />agreement. <br />35 <br />
