ARTICLE 24 - NEW AND CHANGED JOBS <br />Section 1. If substantial changes occur in the method of operations, tools or <br />equipment of a job, or if a new job is established within the general scope of the work <br />performed by members of this unit, the City shall establish and describe the content of <br />the job and it shall establish a pay structure for that job. The content of the job and the <br />pay structure shalt then be reviewed with the Union. If the Union is not in agreement <br />with the rate of pay for the job, it can file a grievance at Step 3 of the Grievance <br />Procedure within thirty (30) days following the termination of discussions concerning the <br />rate of pay. If the grievance is arbitrated, the arbitrator shatl have the authority to <br />recommend the proper rate of pay for the job or he shall recommend placing the job <br />within the rate of pay for that classification. Any decision of the arbitrator shall be <br />submitted to the Council of the City of North Olmsted. The Council shall have thirty (30) <br />days to review said decision within which time they may, by a two-thirds vote (or 5 <br />votes) of all members of Council, reject the arbitrator's recommendation. If the Council <br />fails to reject the recommendation by the required. vote, then the arbitrator's <br />recommendation shall become final and binding and the rate of pay shall be retroactive <br />to the commencement of discussions between the Union and the City in accordance <br />with this Article. Any rate and classification agreed to by the City and the Union or <br />recommended as provided herein by an arbitrator and not rejected by Council shall <br />become part of the wage schedule to this Agreement. In the event the Council rejects <br />the arbitrator's recommendation, as herein before provided, the initial procedure of this <br />Article shall be reinstituted until a recommendation is accepted or an agreement is <br />reached. The City shall not arbitrarily or capriciously reclassify employees or change job <br />description during the life of this Agreement. <br />30 <br />
