ARTICLE 27 - SAFETY AND HEALTH <br />Section 1. The City and the Union recognize that each party must compiy with <br />the applicable state and federal laws with respect to safety and health. The City shall <br />continue to make reasonable provisions for the safety and health of its employees. <br />A. Required personal protective equipment shall be issued to regular full- <br />time employees and shall be replace if the equipment is worn out and is <br />returned to the City for replacement. <br />An employee who does not return the equipment will be charged for the replacement <br />cost, except in cases, <br />(1) In which the equipment was destroyed by accidental conditions <br />beyond the employee's control in the work area, or <br />(2) If the equipment has been stolen and the City has failed to supply <br />the employee with a place to lock up his equipment. <br />B. A safety committee consisting of the Service director and his designee <br />and two (2) safety representatives appointed by the Local Union shall <br />confer at regular monthly intervals, if necessary, for the purpose of <br />attempting to maintain safe working conditions for employees in the <br />Bargaining Unit. Additional meetings may be held if required by unusual <br />circumstances_ The Safety Committee shall have the authority to deal <br />with safety procedures, safety and sanitation problems, and shall decide <br />upon the protective equipment to be used under Paragraph A. <br />Section 2. In the event an employee reasonably believes that a situation is <br />unsafe, the employee shall notify his supervisor irrimediately. the supervisor shall <br />investigate the situation on the same day or as soon as possible thereafter, and take <br />such steos as are necessary to remedy the unsafe condition. <br />ln the event the empioyee has notified his supE:rvisor of the unsafe condition, the <br />employee shall not be required to perform the work until it has been determined to be <br />safe However, the employee may be assigned to alternative duties until such time as <br />an Mves-!gation is completed. <br />33 <br />
