(b) An employee shall accumulate seniority during any leave of <br />absence, but he shall not be entitled to any benefits, except <br />that the City shali continue to pay its portion of the emplayee's <br />hospitalization insurance in Article 19 for a three (3) month <br />period. After the #hree (3) month period, an employee must <br />direct pay any required hospital/surgical premiums to the <br />City on or before the monthly due date. <br />(c) When an employee retums to work after a leave of absence, <br />he will be assigned to the position which he formerly occupied <br />at the then current rate of pay, or to a similar position if his <br />former position no longer exists, if he is physically qualified for the <br />job. In the event, the City questions whether the employee is <br />physically able to do the work, the City will require the employee to <br />furnish a City supplied medical certificate of a physician supporting <br />his claim of fitness, and the City shall have the right to have the <br />employee examined by a doctor of its choice. If disagreement <br />thereafter exists, a third physician shall be mutually selected by <br />the Union and the City to determine the issue, and the opinion <br />of the third physician shall be final on the parties. The charges <br />made by the third physician shall be shared equally by the City <br />and the Union. <br />(d) INJURY ON DUTY: Secretaries working within the Division of <br />Police while actually performing Matrons duties who are <br />temporarily incapacitated from a sudden and accidental injury <br />to the degree that the employee can not perform secretarial <br />duties, said injured Secretary, shall be eligible to use up to <br />eighty (80) hours (10 working days) o# sick leave without such <br />sick feave use affecting the individuals accumulated sick leave <br />credit nor the employees attendance bonus days. To be eligible, <br />the injury must be a direct result af work performed as a Matron <br />and shall not be a result of slipping, tripping, falling, lifting, or <br />other injuries that may occur while performing duties other than <br />Matron duties. <br />If it is found that a leave of absence is not actually being used for the purpose for which <br />it was granted, the City shall cancel the leave and it may impose disciplinary action up to and <br />inciuding discharge. <br />ARTICLE 12 - LAY-OFFS <br />Section 1. Whenever it is necessary for the City to reduce its forces, the employees <br />within the department to be reduced, will be laid off in the fiollowing order: <br />?- <br />? <br />17 <br />141
