ARTICLE 21 - SAFETY AND HEALTH Section 1. The City and the Union recognize that each party must comply with the applicable state and federal laws with respect to safety and health. The City sha!l continue to make reasonab(e provisions for the safety and health of its employees. (Recreation Department and Maintenance Personnel Only) A. Required personal protective equipment shall be issued to regular tuli-time empioyees and shall be replaced if the equipment is worn out and is returned to the City for replacement cost, except in cases: (1) !n which the equipment was destroyed by accidental conditions beyond the employee's control in the work area, or (2) If the equipment has been stolen and the City has failed to supply the employee with a place to lock up his equipment. B. A safety committee consisting of the appropriate Director af his designee and two (2) safety representatives appointed by the Local Union shall confer at regular monthly intervals, if necessary, for the purpose of attempting to maintain safe working conditions for employees in the Bargaining Unit. Additionai meetings may be held if required by unusua( circumstances. The Safety Cammittee shall have the authority to deai with safety procedures, safety and sanitation prob(ems, and shali decide upon the protective equipment to be used under Paragraph A. Section 2. in the event an employee reasonably believes that a situation is unsafe, the employee shall notify his supervisor immediately. The supervisor shall investigate the situation on the same day or as soon as possible thereafter, and take such steps as are necessary to remedy the unsafe condition. !n the event the employee has notified his supervisor of the unsafe condition, the employee shall not be required to perform the work until it has been determined to be safe. However; the employee may be assigned to alternative duties until such time as an investigation is completed. 29
