ARTICLE 21 - SAFETY AND HEALTH <br />Section 1. The City and the Union recognize that each party must comply with the <br />applicable state and federal laws with respect to safety and health. The City sha!l continue to <br />make reasonab(e provisions for the safety and health of its employees. (Recreation <br />Department and Maintenance Personnel Only) <br />A. Required personal protective equipment shall be issued to regular <br />tuli-time empioyees and shall be replaced if the equipment is worn <br />out and is returned to the City for replacement cost, except in cases: <br />(1) !n which the equipment was destroyed by accidental <br />conditions beyond the employee's control in the work <br />area, or <br />(2) If the equipment has been stolen and the City has <br />failed to supply the employee with a place to lock up <br />his equipment. <br />B. A safety committee consisting of the appropriate Director af his <br />designee and two (2) safety representatives appointed by the <br />Local Union shall confer at regular monthly intervals, if necessary, <br />for the purpose of attempting to maintain safe working conditions <br />for employees in the Bargaining Unit. Additionai meetings may be <br />held if required by unusua( circumstances. The Safety Cammittee <br />shall have the authority to deai with safety procedures, safety and <br />sanitation prob(ems, and shali decide upon the protective <br />equipment to be used under Paragraph A. <br />Section 2. in the event an employee reasonably believes that a situation is unsafe, the <br />employee shall notify his supervisor immediately. The supervisor shall investigate the situation <br />on the same day or as soon as possible thereafter, and take such steps as are necessary to <br />remedy the unsafe condition. <br />!n the event the employee has notified his supervisor of the unsafe condition, the <br />employee shall not be required to perform the work until it has been determined to be safe. <br />However; the employee may be assigned to alternative duties until such time as an <br />investigation is completed. <br />29 <br />
