P. t=r-4 <br />SECTION 7: The employee shall be into7^med of the nature of <br />the xnvestigatzon prxor to any questa.oning and shall be informed, <br />to the extent }cnown at the time, whethex the investigation is <br />focused an the member fax a potential chaxge. If the employee <br />requests it, he shall be given bza.ef time prior to any <br />questioning to 2ocate and review any documents he possesses <br />regarding the event(s) being investigated in order to fully <br />prepare himself to accurately and comp].etely respond to tha <br />questioning. An investigating ofFicer may accampany the member <br />duxing his brief search and review oE documents. The Employee <br />shal7: have a reasonable time period in which to obtain Iegal <br />counsel or a repxesentative of the bax'gaining unit. <br />SECTZON 8: If the employee about to be xnterrogated shall be <br />under arrest, ox is a saspect in a cxi.minal invEStigation and the <br />answers which ttie erqploXee is asked to make to interxogator$, and <br />infQrmation dexived from such answers will be used in a criminal <br />trial, the employee shall be completely informed of all his <br />Constxtutional Rights prior to the commencement of any <br />interrogatxon. <br />SECTIDN 9: The employee under investigation shall be informed <br />of the names and addresses of all complainants upon request. The <br />complainant may be infarmed of the riame of the emp3.oyee upon <br />request. The emp].oyee will be provided wxth a copy of the <br />complainant's infoxmation upon x-equest. The investigating o£f icer <br />of the cdmplaint may be the comp].ainant. <br />SECTION ld: In imposing disca.pline on a current charge, the <br />City will nat base pxogressive discipline on prior dxsciplinary <br />action which is more than three (3) years old, except for prior <br />disciplinary action involving cases of vxalence ox theft. <br />ARTICLE $: <br />ASSOCIATIOPt REPRESEN"xATION <br />SECTZON 1: The parties recognize that it may be necessary for <br />an emplayee representatxve of the OP13A to leave a normal warlc <br />assignmerzt while acting in the capacitiy of representative. The <br />oPBA recognxzes the operatzonal needs o£ the Employer and will <br />cooperate to keep to a minimum trie time lost from work by <br />representatives. Befax'e leaving an assignrnent pux'suant to this <br />section, the representative must obtain approval fram the officex <br />xn charge of the shift. The Employer will campensate a <br />representative at the r,ormal rate for the time spent in the goad <br />faxth processing af grievances, and at any meetxngs at whzch the <br />Employer requests a representative to be present. <br />SECTI4N 2: Members of the Neqotiating Comxnititee sha1l be <br />allowed reasonabl.e time off to pax'ticipate in collective <br />6
