TO 7 7 758 8=+ P. <br />AR2"IC7,E 7: <br />LMPLOYEE RxGHTB <br />SECTION 1: An employee has the right to the presence and <br />advice of the OFBA representative at a11 da.sciplinary <br />znterrogations. <br />SECTION 2: An empZoyee who is to be questioried as a suspect <br />in any investigation of any criminal charge against hi.m shall be <br />advised of his canstitutional xights before any questioning <br />starts. <br />SEGTIdN 3: Before an employee may be chargad with any <br />violation of the Rules and Regulations fox a refusal to answer <br />questions or participate in any investi.gatiori, he shall be <br />advised that his xefusal to answer such questions or participate <br />in such investigation will be the basis of such a charge. <br />SECTION 4: Questioning or interviewing of an employee in the <br />course of an intex-na2 investi,gation will be conducted at hours <br />reasQnable related ta the employee's shift, unless operatiana1 <br />necessities require otherwise. Interrogation sessians shall be <br />for reasonabze periods of time, and txme sha3.l be provided for <br />xest periods and attendance to physical necessities. In addition, <br />tapes will on2y be made by the Cxty. The Dispatchex and his <br />attorney znay have access to the tapes, if approved by the Law <br />Director, Prosecutor's Office, or the Civxl Service Commissian. <br />Employees may have a tx-anscript of such recording at the <br />employee1$ expense. <br />SECTZON 5; An employee will be informed of the nature o;E the <br />investigation a£ himself prior to any questioning. If the <br />ezrrployee bea.ng questioned is, at that time, a witness and not <br />under investigatian, he shall be so advised. <br />SECTION 6: The officxal personnel file will be lQCated in the <br />affice of the Chief of Palice. No natice will be x-equired ta <br />inspect the file by tkae employee, except that the employee is <br />limited to fiftee» (15) minutes of the shzft. The emplayee may <br />inspect his file during nonworking hours, but in any event shou7.d <br />the Ghief of Poliae or his Secretary not be avaiZable upon a:Eile <br />inspection visit, his inability tp inspect the file at that ta.me <br />shall nat be the basis vf a grxevance. The City shall insure that <br />all documents placed in the employees' afficial persannel file <br />shall be first xnitialed and dated by the employee concerned. The <br />initialing of any matexxai to be placed into any employees' <br />personnel x-ecord will not indicate an aqreement by the employee <br />as to trie contents of ttxe material, but does acknowledge he has <br />seen it. <br />5
