F1 <br />tp jain tha OPBA or not join the OPBA, shall file a written <br />complaint with the Director of Pub2ic Safety no later than thirty <br />(30) days following the date of the last incident. Upan reaeipt <br />of suah written complaint, the Director of Public Safety shall <br />have the right and authority to discuss and explain the remedies <br />available under Chapter 4117. of the Ohio Revised Code with the <br />affected employee. The OPBA may have a repxesentatzve preserit <br />when the aforementioned rpmedxes axe discussed with the affected <br />employee. <br />SECTION 5: All references to empioyees in this agreement <br />designaLe both sexes, and wherever the male gender is used, it <br />shall be constxued to mean male and fernale. <br />ARTIGI,E 6: <br />NO STItIKE/NO LOCROUT <br />SECTION 1: The Employer and the OPBA agree that the gx-ievance <br />proceduxes provided herein are adequate to provide a fair and <br />fxnal determination of al-i grzevances arising under this <br />Agreement. It is the desire of the Emp2oyer and the OPBA to avoxd <br />work stoppages and strikes. <br />SECTION 2: Neither the OPBA nox any member of the bargaining <br />unit, fox the duration of thS.s Agreement, shall directly or <br />indirectly call, sanction, encourage, finance, partxcipate, or <br />assist in any way in any strike, slawdown, walkQUt, concerted <br />"sick leave" ar mass resignation, wark stappage or slowdown, or <br />other unlawfuZ interference with narmal operations of the <br />Employer for the duration of this Agxeement. A breech of this <br />Sectian may be grounds fox discipline. The OPBA shall not be held <br />liable for the unauthorized activity of the employees it <br />represents ar its members who are in breach of this section, <br />pravided that the oPBla meets all of its obligations under this <br />Ax-ticle. <br />SECTIOid 3: The OPBA shall, at a?l times, cooperate with the <br />Employer in coxatinuing operations in a normal manner and shall <br />actively discourage and attempt to prevent any violation of the <br />"no-strike" clause. <br />xn the event of a vxvlation of the "na-stxxke" clause, the <br />OPBA shall promptly natzfy all employees in a xeasonable manner <br />that the strike, work stoppage or slowdown, or other unlawful <br />interference with normal opexations of the Emplayex is in <br />violatxan of this Agreement, unlawful a»d nat sanctionEd or <br />approved by the OPBA.
