Employees who have reaeived a Reli.giaus <br />Exemption fram the State Emp2oyment Relatxons Board are exempt <br />from having dues, assessments and/or a fair share fee deducted <br />from their pay check(s). Ali full-time employees hired after the <br />effective date of tlaxs agreement who voluntari3.y choose not to <br />riecome dues paying members of the OPBA, shall pay the fair share <br />fee, effective sixty (60) days from tkxe employees date of hxxe. <br />The deductian of the fair share fee shall be automatic and does <br />not require a written authori2atxon for a payroll deductzon. <br />Payment to the Associatian of £air share fees shall be made zn <br />accordance with the procedure cozataxned within Section 2, above. <br />SECTION 5: In the event that a service fee is tQ be cha.rged <br />to a dues paying member of the OPBA, the Entplayex shall deduct <br />such fee in the same manner as dues are deducted as speai.fied in <br />Section 2, above. <br />AItTIGLE 5: <br />NON--DI3CRIMINATION <br />SECTION 1: Both the Emplayer and the OPBA recognize their <br />respective responsibilities under the Federal and State Civil <br />Right Laws, Fair Employment Pxactices Act, and other similar <br />constitutX4naZ and statutory requireme-nts. Therefore, both the <br />E7nployer and the OPBA hereby reaffirm their commitment, legal and <br />moral, not to discriminate in any manner relating to employment <br />an the basis of race, color, creed, national origin, disability, <br />sex ar age. The OPBA shall share equal.ly with the Employer, the <br />respansibili.ty for applying this provision of the Agreement. The <br />OPBA and all callective bargaining unit members shall not <br />discriminate against any pexson or persons, in any manner <br />relating to their empioyment on the basis of race, color, creed, <br />national origin, marital status, political affiliation, <br />dzsabilitX, sex or age. "Sex" includes a prohibition against <br />sexual harassment. <br />SEGTION 2: The ErnpZayer ayrees not to interfere with the <br />rights of employees to become members of the 0P8+A., and there <br />shall be na discrXminati:an, interference, restraint or coercion <br />by or against any employee because of OPBA membership, or lack of <br />OPBA membership. <br />SECTIDN 3: The OPBA recagni2es its responsibilities as a <br />bargaining unit to membexs and non--members alike, without <br />discriminatian, interference, restraint or coercian. <br />SECTIaN 4: The OPBA and the Employer recognize the right of <br />all employee(s) ta be free to join or not join the OPBA and shal.l <br />not coerce employee in any manner to join or not join the OPBIa. <br />Employees wha believe that the OPBA, the Emp].ayer, or any member <br />of the OPBA has attempted to coerce, intimidate ar threaten them <br />3 <br />
