A. -- TQ ARTICLE 13: LAYOFF ANU RSGALL SECxION 1: When a 1.ayaFf is neoessary due to lack of funds or lack of war}c, the Employer shall notify the effected emp3oyees in writing at least fourteen (24) daXs in advance of the effective date of layaff. The Employer, upon request from the OpBA, agrees to advise the representatives of the OPBA, the impact of the layof f on bargaining unit employees. SECTION 2: lEmployees shall be I.aid off in accordance with their departmental senzority, Iast hired, fXrst laid off. SECTION 3: Employees who are laid off shall be placed on a recall list £or a period equal to their length of service not ta exceed thirty szx (36) znonths. If there is a recall, empl.oXees who are still on the recall list shall be xecalled in the invezse oxder of their lay off, last laid off, first recalled. SECxION 4; Notice of recall sha13 be sent to the emp].oXee(s) by xegistered mail, with a copy to the OPBA. The Employer sriall be deemed to have ta have fulEilled its obligation by mailing the x-ecal.l natice bx regi.stered mail, return receipt requested, to the 3ast mailing address of the empl.oyee. SECTIaN 5: The reca?.led employee shal2 have ten {10} calen:dar daXG followi.ng the date of receipt of the recall notxce, ta notify the Emplvyer of the employee's intent to retuxn to woxk. SECTION 6: Before any full-time employee may be 1.aid off, all part-time employees will be first laid off. ARTICLE ia: MISCELLAWEOUS SEGTIbN 1: In any instance where the Employer sends an employee for a medical examinaticsn, the Emplayer shall pay the cost of the examination and sha].l pay the employee for the time expended taking such examinatian.
