Section 4.03. All requests for cancellation of payroll deductions for dues shall be processed <br />through the NOTEA's Treasurer. All approved cancellations will be forwarded to the City's <br />Director of Finance with a request for cancellation. <br />Section 4.04. The NOTEA agrees to hold the Employer harmless from any and all liabilities <br />or damages which may arise from the performance of its obligations under this Article and <br />indemnify the Employer for any such liabilities or damages that may arise. <br />ARTICLE V <br />MANAGEMENT RIGHTS <br />Section 5.01. Except as specifically abridged by the expressed written terms of this agreement, the <br />Employer should have all rights and prerogatives, including, but not limited to the following: <br />l. Determine all matters of inherent managerial policy which includes, but are not <br />limited to, areas of discretion or policy such as the functions and programs of the <br />employer, standards of service, its overall budget, utilization of technology, and <br />organizational structure. <br />2. Employer has the right to direct, supervise, schedule, evaluate, the right to <br />determine the number of employees, the right to hire, fire, assign, demote, <br />transfer, promote and right to discipline with just cause, the right to establish and <br />enforce rules and policies not in conflict with the terms of this agreement, the <br />right to lay off, because of lack of work or economic necessity and to introduce <br />new or improved methods, equipment and facilities. <br />3. Employer has the right to determine the overall methods, prooess, means and or <br />personnel by which governmental operations are to be conducted. <br />Section 5.02. The operator run schedules are provided by the Greater Cleveland Regional <br />Transit Authority and are subject to their regulations in the distribution and configuration of these <br />runs. <br />ARTICLE VI <br />NOTEA RIGHTS <br />Section 6.01. The NOTEA membership shall have the exclusive right to choose their <br />representative according to the provisions of the Constitution and Bylaws of the NOTEA. <br />Section 6.02. <br />(a) The Service Director or his designee shall meet at least once monthly <br />with the NOTEA representatives, at mutually agreeable times, to discuss <br />problems and policies as they relate to established Transit policies <br />and procedures. Additional meetings rnay be called my mutual <br />agreement at the request of either party to discuss mutual problems. <br />(b) NOTEA representatives shall give advance notification to the Service <br />Director, or his designee, of the topics to be discussed and vice versa. <br />~ Section 6.03.
