If after such ninety (90) days sick leave period, said employee is still temporarily <br />incapacitated, then the Director of Public Safety shall recommend to Council whether or <br />not to continue said salary. Council shall forthwith review the matter and by majority <br />vote, determine whether the employee shall continue to receive his full salary during <br />recuperation. <br />For the purpose of this paragraph, a sudden and accidental injury shall include such <br />incidents as an automobile accident, assault, gun shot wound and the like. It may not be <br />considered as sudden and accidental if an injury or incapacitation results from lifting, <br />slipping, tripping or falling. <br />13.3 Any full-time employee of the bazgaining unit who qualifies for benefits under <br />this Section shall be required to pay over to the City any amount received from the <br />Bureau of Workers Compensation as supplemental wages. Further, if at any time the <br />City determines, on the basis of inedial evidence, that employee is permanently disabled <br />and will no longer be able to carry on his duties, then the City may terminate payments <br />and insist that employee go on a pension program. <br />13.4 Any employee who qualifies for the benefits under this Section, shall not have <br />his accumulated sick time reduced because of a qualified accidental injury which <br />occurred while in the line of duty. <br />13.5 If an employee, including part-time employees, is absent on sick leave for more <br />than three (3) consecutive work days, the City shall require the employee to present <br />medical evidence that the employee was under a doctor's care and is able to return to <br />work. The City will review the attendance records of employees periodically and at least <br />once in each three (3) month period. If it believes that an employee is developing an <br />attendance problem, he will notify the employee in writing that medical evidence will be <br />required for absences of three (3) days or less.
