1nh <br />;~ <br />70-136 <br />- 2 - <br />Section 3: Removal <br />Upon concurrence of two-thirds of the members of Council, <br />the Council may, after public hearing, remove the Mayor from <br />office for his disqualification while in office, for his con- <br />viction while in office of a crime involving moral turpitude, <br />or for a violation of his oath of office. Prior to such removal <br />action, the Mayor shall be notified in writing of the charge or <br />charges against him at least fifteen (15) days in advance of any <br />hearing upon such charge or charges, and he and his counsel shall <br />be given an opportunity to be heard, present evidence, and examine <br />any witness appearing in support of such charge or charges." <br />2. That Sections 1 and 2 of Article IV and Section 7 of Article IX of <br />the Charter relating to the Council be amended to increase the <br />membership of Council from seven to nine, six of whom shall be <br />elected from wards, and to measure the residency requirement from <br />the date of filing nominating petitions rather than from the <br />date of election, such amended Sections 1 and 2 of Article IV <br />and Section 7 of Article IX to read as follows: <br />" ARTICLE IV <br />THE COUNCIL <br />Section 1: Number and Terms <br />Until January 1, 1972, all legislative powers of this City, <br />except as otherwise provided by this Charter and by the Con- <br />stitution of the State of Ohio, shall be vested in a Council of <br />seven members, four or whom shall be elected by the several wards <br />and three of whom shall be elected at large. On and after <br />January 1, 1972, such legislative powers shall be vested in a <br />Council of nine members, six of whom shall be elected by the <br />several wards and three of whom shall be elected at large. <br />Members of Council, including the President of Council, <br />shall be elected at the regular municipal election in the year <br />1951 for a term of two years and every second year thereafter <br />for a term of two years. All members of Council and the Presi- <br />dent of Council shall assume office on the first day of January <br />next following their election. <br />Section 2. qualifications <br />No person shall be eligible to be a member of Council unless <br />he shall have been a qualified elector and resident of this City <br />for at least two (2) years immediately prior to the final date for <br />filing nominating petitions for such office and shall continue to <br />be a qualified elector and resident therein during his term of <br />office. <br />Except as otherwise provided in this Charter, no member of <br />Council shall hold any other municipal office or e~ttployment by <br />the City of North Olmsted. A member of Council shall not directly <br />or indirectly solicit, contract for, receive or be interested in <br />any profit or emolument from or on account of any contract, job, <br />work or service with or for the City. <br />Any member of Council who ceases to possess any such qualifi- <br />cations, or moves from his ward, if elected from a ward, or from <br />the City, if elected from the City at large, shall forfeit his <br />office." <br /> <br />
