t" . <br />~..-r <br />70-136 <br />- 3 - <br />"Article IX, Section 7: General Provisions <br />After the 1970 and each recurring Federal Census and within <br />three months after the issuance of the proclamation by the <br />Secretary of State certifying the population of the City, or <br />when there is annexed thereto any territory, the Council shall <br />re-district the City into six (6) wards, if necessary, so as to <br />have each ward as nearly equal in population as practicable and <br />which shall be bounded by county lines, streets, alleys, avenues, <br />public grounds, canals, water courses, municipal corporate lines, <br />or center lines of platted streets in said ward. <br />If the Council fails to make such subdivision within the <br />time required, it shall then be made by the Director of Public <br />Service. <br />Where no special provision is made in this Charter govern- <br />ing general, primary or special elections, registration and the <br />conduct of such elections, the provisions of the general laws of <br />the State of Ohio shall control. The special time limitations <br />of such general laws go~trning the holding of a primary election <br />prior to a special election to fill a vacancy shall apply to the <br />primary election to be held prior to the regular municipal elec- <br />tion for the purpose of nominating candidates for the unexpired <br />term of an elected officer where this Charter provides for the elec- <br />tion of a successor." <br />3. That Section 2 of Article V of the Charter relating to the Director <br />of Law be amended to increase the term of office from two years to <br />four years, to measure the residency requirement from the date of <br />filing nominating petitions, to provide the method of filling a <br />vacancy in his office, and to establish a procedure for his removal <br />by Council under certain circumstances, such amended Section 2 of <br />Article V to read as follows: <br />"Article V, Section 2: Director of Law <br />The Director of Law shall be the head of the Law Department <br />of the City and, commencing with the regular municipal election <br />in the year 1971 and every fourth year thereafter, he shall be <br />elected for a term of four (4) years. His term shall begin and <br />he shall assume office on the first day of January next following <br />such election. The Director of Law shall be empowered to designate <br />such assistants as shall be authorized by and approved by Council. <br />No person shall be eligible to be the Director of Law unless he <br />is authorized to practice as an attorney in Ohio and has been <br />engaged in the active practice of law in Ohio continuously for a <br />period of five years next preceding his election, has been a <br />qualified elector and a resident of the City for at least two <br />years immediately prior to the final date for filing nominating <br />petitions for such office, and shall continue to be a qualified <br />elector and resident of the City during his term of office. <br />In the event the office of Director of Law shall become <br />vacant for any reason, the Mayor shall appoint a successor, sub- <br />ject to confirmation by a majority of the members of Council, <br />to serve for the unexpired term or until the election of a <br />successor for the unexpired term at the next regular municipal <br />election provided that, (a) such election shall occur more than <br />two (2) years prior to the expiration of the unexpired term, and <br />(b) the vacancy shall have occurred more than one hundred twenty <br />(120) days prior to such election. <br />
