:~~ <br />F,r <br />70-136 <br />- 4 - <br />Upon concurrence of two-thirds of the members of Council, <br />the Council may, after public hearing, remove the Director of <br />Law from office for his disqualification while in office, for <br />his conviction while in office of a crime involving moral tur- <br />pitude, or for a violation of his oath of office. Prior to such <br />removal action, the Director of Law shall be notified in writing <br />of the charge or charges against him at least fifteen (15) days <br />in advance of any hearing upon such charge or charges, and he and <br />his counsel shall be given an opportunity to be heard, present <br />evidence, and examine any witness appearing in support of such <br />charge or charges. <br />The Director of Law shall act as legal counsel and serve <br />in such capacity the Mayor, Council, administrative officers, de- <br />partments, and the commissions and boards of the City. As <br />legal counsel and attorney, he shall represent the City in all <br />proceedings in court or before any administrative body and in <br />such other matters and controversies as he is by resolution or <br />ordinance directed to prosecute. He or an Assistant Director <br />of Law shall act as Prosecuting Attorney for the City. He shall <br />perform all other duties now or hereinafter imposed upon city <br />solicitors by the laws of the State of Ohio unless otherwise pro- <br />vided by ordinance of the Council and shall perform such d~~a~~s <br />as Council and the Mayor may impose upon him consistent with his <br />office. <br />In the absence of the Director of Law for any reason, the <br />first assistant director of law shall perform all of the duties <br />herein imposed upon the Director of Law." <br />4. That Section 3 of Article V of the Charter relating to the Director <br />of Finance be amended to increase the term of office from two years <br />to four years, to measure the residency requirement from the date of <br />filing nominating petitions, to provide the method of filling a <br />vacancy in his office, and to establish a procedure for his removal <br />by Council under certain circumstances, such amended Section 3 of <br />Article V to read as follows: <br />"Article V, Section 3: Director of Finance <br />The Director of Finance shall be on a full-time basis, with <br />his office to be conducted from the Municipal Building, and shall <br />be the head of the Finance Department and the Fiscal Officer of <br />the City. Commencing with the regular municipal election in the <br />year 1971 and every fourth year thereafter, he shall be elected <br />for a term of four (4) years. His term shall begin and he shall <br />assume office on the first day of January next following such <br />election. No person shall be eligible to be the Director of <br />Finance unless he shall have been a qualified elector and resident <br />of the City for at least two years immediately prior to the final <br />date for filing nominating petitions for such office, and shall <br />continue to be a qualified elector and resident of the City during <br />his term of office. The Director of Finance shall at the time of <br />his election be either a certified public accountant or a regis- <br />tered public accountant with a minimum of five years public or <br />private accounting experience immediately preceding his declaration <br />of candidacy. <br />In the event the office of Director of Finance shall become <br />vacant for any reason, the Mayor shall appoint a successor, sub- <br />ject to confirmation by a majority of the members of Council, to <br />serve for the unexpired term or until the election of a successor <br />for the unexpired term at the next regular municipal election pro- <br />vided that, (a) such election shall occur more than two (2) years <br />prior to the expiration of the unexpired term, and (b) the vacancy <br />shall have occurred more than one hundred twenty (120) days prior <br />to such election. <br />
