~, <br />70-136 <br />- 5 - <br />Upon concurrence of two-thirds of the members of Council, the <br />Council may, after public hearing, remove the Director of Finance <br />from office for his disqualification while in office, for his <br />conviction while in office of a crime involving moral turpitude, <br />or for a violation of his oath of office. Prior to such removal <br />action, the Director of Finance shall be notified in writing of <br />the charge or charges against him at least fifteen (15) days in <br />advance of any hearing upon such charge or charges, and he and <br />his counsel shall be given an opportunity to be heard, present <br />evidence, and examine any witness appearing in support of such <br />charge or charges. <br />He shall serve the Mayor and the Council as financial ad- <br />visor in connection with municipal affairs, and he may serve as <br />Clerk of the Council. In such capacity or capacities, he shall <br />keep the records of said bodies, and shall authenticate all <br />records, documents and rostrum ents of the City on which authenti- <br />cation is proper. The Director of Finance shall examine all pay- <br />rolls, bills and other claims against the City and shall issue no <br />warrant unless he shall find that the claim is in proper form, <br />correctly computed and duly approved, and that it is due and pay- <br />able, and that. an appropriation has been made therefor;,~and he <br />shall perform all other duties now or hereafter imposed upon City <br />Auditors or Treasurers by the laws of the State of Ohio unless <br />otherwise provided by this Charter, or by ordinance of the Council, <br />and he shall perform such other duties as the Mayor may impose upon <br />him consistent with his office." <br />5. That Sections 1, 4 and 5 of Article V and Section 3 of Article VII <br />of the Charter be amended to prohibit Council from abolishing or <br />combining departments or divisions thereof established by the <br />Charter, to require full-time Directors of Public Safety and Public <br />Service, to reorganize the Departments of Public Safety and Public <br />Service and the Parks and Recreation Commission, and to provide for <br />an advisory commission on juvenile delinquency, such amended Sections <br />1, 4 and 5 of Article V and Section 3 of Article VII to read as <br />follows: <br />"Article V, Section 1: General Provisions <br />A Department of Law, a Department of Finance, a Department <br />of Public Safety, and a Department of Public Service are hereby <br />established, and the Council shall provide by ordinance for the <br />organization thereof. The Council may establish by ordinance new <br />departments or divisions thereof. Except as to departments or <br />divisions thereof established by the Charter, Council may combine <br />or abolish departments and divisions as it may deem necessary and <br />may authorize one person to be the head of two or more departments <br />or divisions. Except as otherwise provided by this Charter, all <br />appointments and removals in the several departments shall be made <br />by the respective directors." <br />Article V, Section 4: Department of Public Safety <br />The Director of Public Safety shall have charge of the De- <br />partment of Public Safety. He shall make all necessary rules and <br />regulations for the government of the department and the divisions <br />thereof. He shall not hold any other elective or appointive of~ <br />fice or other full-time employment, public or private. He shall <br />be charged with the duty of enforcing all police, fire, safety, <br />health, sanitary, and building regulations that may be prescribed <br />by ordinances or rues of the City or, when applicable, the general <br />laws of Ohio. He shall be charged with the responsibility of <br />developing, operating and maintaining parks and recreation facil- <br />ities and programs for the City, and of initiating and coordinating <br />
