` r <br />- ~ - <br /> <br />9. When there is a reduction in force, the Local Union Officers, <br />Stewards, and Alternate Stewards shall be retained in preference <br />to other employees, provided they can perform the available work. <br />Discipline <br />10. In case of a suspension or discharge, the employee shall have the <br />right to have his steward present and, upon request, will be per- <br />witted to discuss his suspension or discharge with the steward in <br />an area made available by the City before he is required to leave <br />the premises. An employee who is suspended or discharged shall be <br />given a written notice of the disciplinary action with a copy to <br />the Union, stating the reason for the discipline within twenty-four <br />(24) hours. Disciplinary action may be appealed by the Union <br />through the Grievance Procedure commencing at Step 2 of the Grie- <br />vance Procedure, provided however that if disciplinary action is <br />appealed by the employee to the Civil Service Commission, any pend- <br />ing grievance protesting such discipline shall immediately be re- <br />moved from the Grievance Procedure and the employee's appeal shall <br />be determined exclusively by the Civil Service Commission. An <br />employee who desires to protest the disciplinary action must make <br />an election within ten (10) calendar days Following receipt of the <br />written notice as to whether he wishes to pursue the grievance pro- <br />cedure or appeal to the Civil Service Commission. Recourse to <br />either procedure will be final and binding and shall exclude recourse <br />to the alternate procedure. <br />Grievance Procedure <br />11. It is mutually understood that the prompt presentation, adjustment, <br />and answering of grievances is desirable in the interest of sound <br />relations between the employee and the City. The prompt and fair <br />disposition of grievances involves important and equal obligations <br />
