r <br />-6- <br /> <br />Step 3: The Union may appeal the grievance to the Mayor or his desig- <br />nated representatives by giving him~notiee in writing within seven <br />(7) working days following receipt of the Step 2 answer. The Mayor, <br />together with such representatives as the Mayor deems appropriate, <br />shall meet with the Local Union Grievance Committee to consider the <br />grievance within ten (10) working days following receipt of the <br />appeal. A representative of District Council 78 may participate <br />in arty such meeting. The Mayor will answer the grievance in writing <br />within five (5) working days following completion of the Step 3 <br />discussions. <br />Step ~+: If the grievance is not satisfactorily settled at Step 3, the <br />Union may, within thirty (30) calendar days after receipt of the <br />Step 3 answer, submit the matter to advisory arbitration. The <br />Union shall notify the City of its intent to appeal the grievance <br />to arbitration in writing. Promptly thereafter representatives of <br />the City and the Union shall meet for the purpose of attempting to <br />select an Arbitrator by agreement. If they cannot so agree, the <br />Union shall send written notice of its intent to arbitrate the <br />grievance to the American Arbitration Association. The American <br />Arbitration Association shall submit a panel of seven (7) arbitra- <br />tors to each party and the Arbitrator shall then be chosen in <br />accordance with the Association's then applicable rules. The fees <br />and expenses of the Arbitrator, including expenses of meeting room <br />and stenographic service, shall be borne equally by the parties. <br />13. In the event a grievance goes to advisory arbitration, the advisory <br />Arbitrator shall have jurisdiction only over disputes arising out <br />of grievances and the Arbitrator shall have no authority to add to, <br />subtract from, or modify in any way the provisions of this Memorandum. <br />.. <br />} <br />
