? <br />? <br />OR <br />mW <br />hand deliver a copy of same to a Union officer or steward. <br />Disciplinary action may be appealed by the Union through the <br />Grievance Procedure commencing at Step 2 of the Grievance <br />Procedure, provided however, that if disciplinary action is <br />appealed by the employee to the Civil Service Commission, any <br />pending grievance protesting such discipline shall immediately <br />be removed from the grievance procedure and the employee's <br />appeal shall be determined exclusively by the Civil Service <br />Commission. An employee who desires to protest the disciplinary <br />action must make an election within ten (10) calendar days <br />following receipt of the written notice as to whether he wishes <br />to pursue the grievance procedure or appeal to the Civil Service <br />Commission. Recourse to either procedure will be final and <br />binding and shall exclude recourse to the alternate procedure. <br />(a) H'hen an employee is given a disciplinary action, <br />including a reprimand, the employee will receive a <br />copy of the disciplinary notice placed in the <br />personnel file maintained at City Hall. <br />(b) In imposing discipline on a current charge, <br />the City will not base progressive discipline on <br />prior disciplinary action which is more than two <br />(2) years old, except for prior disciplinary <br />action involving cases of violence or theft. <br />(c) Upon twenty-four (24) hour advance written <br />notice to the Service Director, a Union <br />representative may inspect the official personnel <br />file of any employee who gives such authorization <br />to the Union expressly (forms to be provided by <br />the City). The official personnel file will be <br />located in the office of the Service Director. <br />-6-
