During snow season, employees will be canvassed daily <br />to determine their availability during the ensuing non- <br />shift/overtime hours for snow removal or ice control duty. <br />However, employees who refused overtime but ultimately would <br />not have been called off the list will not be credited with <br />overtime hours worked. The overtime seniority list will be <br />followed and those employees not interested in being called <br />will not be contacted on a subsequent call out unless emergency <br />conditions develop. <br />33. For the purposes of Paragraphs 31 and 32, it shall not <br />be deemed practicable to distribute an overtime opportunity <br />in strict accordance with the overtime lists where: (1) the <br />City, in good faith, estimates that the opportunity consists <br />of no more than one (1) hour of overtime work per man <br />required, or (2) the opportunity arises during an emergency <br />as defined in Paragraph 31. <br />In distributing overtime opportunities, the City or <br />its representatives shall not engage in a policy favoring an <br />employee or employees, unless this Memorandum requires certain <br />employees to work the overtime. <br />LEAVES OF ABSENCE <br />34. Military Leave. An employee shall be granted a leave of <br />absence for military duty under the terms and conditions <br />provided in applicable federal law. <br />-18- ? <br />?
