Should a position in the Transit Department once consolidated be <br />found necessary to be recreated or re-established ,rithin t~•+'o {2) years <br />from the date of consolidation, or should a vacancy occur through <br />death, resignation or other cause within two (2) years frore: the date <br />of consolidation of the position or layoff, the most senior laid-off <br />employee shall be entitled to the position, by classification, provided <br />that on his separation date he had the s~:iil and ability for the <br />position. If an employee laid off as prescribed in this section enters <br />into the active service of the U.S. armed forces such period of <br />service shall not be counted in the two {2) year recall period. <br />Section. 14.05. When a vacancy occurs, the vacancy shall be filled <br />by the employees on the recall list in the order in which the employees <br />are ranked on the list, in their classification., provided the employee <br />has the skill and ability to perform the job in question. An e_~ployee <br />shall be offered a vacancy by the Employer sending a certified letter, <br />return receipt requested, through the U.S. Mail to the employee's last <br />known address with a copy to the NOTEA president. It it the employee's <br />responsibility to inform the Employer of his correct address. If the <br />employee Taishes to accept the vacancy, he must inform the General <br />Manager's office, or his designated representative within one week <br />of receipt of the certified letter. If the employee does not respond <br />within the set period, his name shall be removed from the recall list. <br />Section 14.06. Fart-time employment shall not be permitted chile <br />there is any full-time employee on the active recall list. <br />Section 14.07. During the period a full-titre employee is on <br />lay off, he may continue his health plan coverage, at his own expense, <br />provided during active employment with the Employer, and any improvements <br />,;jade in that health plan coverage. <br />Section 14.08. The Employer shall continue to provide P10TEn with <br />a current recall list. <br />ARTICLE XV <br />DISCIPLItdE <br />Section 15.0. A non-probationary employee who is disciplined <br />shall be given a written notice of such discipline stating the reason(s) <br />therof, within five (5) days from the date of such action. <br />The AtOTEA shall have the right to have a representative present at <br />every step of the disciplinary process. <br />Section 15.02. Any non-probationary employee who is disciplined <br />shall be able to appeal such disciplinary action only through the <br />Grievance Procedure herein contained. <br />Section 15.03. An employee may review his personnel file upon <br />~2asonable notice. The Employer and the e~aployee may have a <br />representative present when this review OCCL1rS. <br />Section 15.04.
