the Employer ceases to provide transit services and as a result therof, <br />GCRTA becomes bound to this Collective Bargaining Agreement, the wages, <br />benefits and other terms and conditions set forth in this Col]ective <br />Bargaining Agreement, automatically ~•rill be modified, if necessary, to <br />conform to the wages, benefits and working conditions provided to GCRTA <br />to its similiar situated employees, provided, however that the foregoing <br />will not in any way affect some accrued benefits, including vacation <br />and sick leave. <br />Section 30.04. The Employer may continue to subcontract work <br />for the NOMBL, as long as it does not cause lay-off or reduction in the <br />NOMBL work force. <br />Section 30.05. The Employer shall institute a revised Drug and <br />Alcohol Policy which complies both with the UMTA regulations and the <br />requirements of the GCRTA operating agreement. <br />Section 30.06. In the event that the Employer ceases, in whole <br />or in part, to provide transit services and sells, assigns, leases or <br />otherwise transfers all or part of the work covered by this agreement, <br />or in the event GCRTA makes a similiar decision such that the Employer <br />ceases to provide transit services, then the Employer shall notify <br />NOTEA, in writing; as soon as the City becomes aware. The use of the word <br />part" above shall not include schedule adjustments, route modifications <br />or cancellations, because of changing ridership demographics. <br />ARTICLE XXXI <br />HOURS <br />Section 31.01. The normal work week for full-time material handlers, <br />hostlers, mechanics and equipment servicers shall be forty (40} hours <br />of cYor}~ in five (5} sight (8) hour days, exclusive of time allotted for <br />meals, during the period starting 12:01 AM Sunday to 12:00 AM (Midnight) <br />Saturday. However, this does not constitute a guarantee of hours or <br />work per day or per week. The Employer reserves the right, as <br />operational needs Gnd conditions require, to establish and change <br />hours of work and schedules of hours. <br />Section 31.02. All full-time maintenance employees are allotted one <br />fifteen (15) minute paid break during the first four (4) continuous <br />hours of their scheduled wor}: and one fifteen (15) minute paid break <br />during the second four (4) continuous hours of scheduled work. All <br />full-time maintenance employees are allotted one fifteen (15) minute <br />paid break before lunch for clean-up time and one fifteen (15) minute <br />paid break immediately prior to the end of each employee's shift. Lunch <br />time shall not be paid. <br />ARTICLE XXXII <br />LOIVGEVITY <br />Section 32.Oi. Full-time employees of the NOT•iBL shall receive <br />the following sums as increments for the years of full-time continuous <br />service with the Employer. For longevity purposes only full-time <br />continuous service with the NOMBL shall be considered. <br />19 <br />
