<br />employee). An employee and the Union will be notified <br />within three (3) working days from the date the application <br />was made of approval or denial of the requested leave. <br />(b) An employee shall accumulate seniority during any leave <br />of absence, but he shall not be entitled to any benefits, <br />except hospital/surgical benefits which shall be provided by <br />the City on a one hundred percent (1000 basis, limited to <br />a three (3) month period after an initial thirty (30) day <br />waiting period. An employee must direct pay any required <br />hospital/surgical premiums to the City on or before the <br />monthly due date. <br />'(c) When an employee returns to work after a leave of <br />absence, he will be assigned to the position which he <br />formerly occupied at the then current rate of pay or to a <br />similar position if his former position no longer exists if <br />he is physically qualified for the job. In the event the <br />City questions whether the employee is physically able to do <br />the work, it will require the employee to furnish a <br />medical certificate of a physician supporting his claim <br />of fitness, and the City shall have the right to have <br />the employee examined by a doctor of its choice. If <br />disagreement thereafter exists, a third physician shall be <br />mutually selected by the Union and the City to determine the <br />issue, and the opinion of the third physician shall be final <br />on the parties. The charges made by the third physician <br />shall be shared equally by the City and the Union. <br />(d) In~ury on Duty: Police Clerks who are working as <br />Matrons, who are injured while on duty shall receive an <br />additional 30 days paid sick leave for said injury. <br />If it is found that a leave of absence is not actually being <br />used for the purpose for which it was granted, the City shall <br />cancel the leave and it may impose disciplinary action up to and <br />including discharge. <br />ARTICLE 12 - LAY-OFFS <br />Section 1: Whenever it is necessary for the City to reduce <br />its forces, the employees within the department to be reduced <br />will be laid off in the following order: <br />(a) Students; <br />(b) Part-time and seasonal employees; <br />- 17 - <br />
