Section 3. This Article shall not be applicable in the <br />event the City and the Union are unable to reach an agreement"on <br />hospitalization in the second and third years of the contract. <br />ARTICLE 24 - MANAGEMENT RIGHTS <br />Section 1. Except as they are specifically restricted or <br />limited by the express language of this Agreement, the City shall <br />retain all of its rights, including without limitation of the <br />foregoing, the right to manage and direct the work force, and to <br />determine the manner and method of performing the work. <br />ARTICLE 25 - SAVINGS CLAUSE <br />Section l: The Union and the City recognize that North <br />Olmsted is a Home Rule City. Therefore, it is the intent of the <br />City and the Union that this Agreement comply in every respect <br />with applicable legal statutes and charter requirements, and if <br />it is determined that any provision of the Agreement is in <br />conflict with law that: provision shall be null and void and shall <br />not affect the validity of the remaining Articles of this <br />Agreement. In the event of an unlawful determination, the City <br />and the Union shall meet within thirty (30) days for the purpose <br />of negotiating a lawful alternative provision. <br />ARTICLE 26 - SUB-CONTRACTING <br />Section 1: The City reserves the right to contract any work <br />that the bargaining unit is unable to perform due to lack of <br />manpower or equipment. The City does agree to limit <br />subcontracting any work that can be done efficiently, safely, and <br />within reasonable time; such work shall be assigned to the <br />bargaining unit. <br />- 28 - <br />
