,. _ . <br />. ? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 83-82 <br />PAGE THREE <br />I. That all full-time employees of the Police Department sha11 be entitled <br />to an annual vacation in accordance with the City of North Olmsted vacation ordinance. <br />All vacation time shall be paid at the regular salary rate except when <br />employee requests vacation credit accumulation. For the purpose of calculating <br />vacation pay, when vacation accumulation is requested by employee, the salary rate <br />at the time 5uch accumulated vacation was requested shall be used to calculate <br />vacation pay. If, due to scheduling, vacations cannot be taken subsequent to the <br />year such vacation was earned and are accumulated and taken in the next subsequent <br />year, the rate of vacation pay shall be at the rate of pay during the year such <br />vacation is taken provided the same is approved by the Director of Public Safety. <br />J. That for purposes of this Ordinance, a work day is defined as a continuous <br />eight (8) hour period and a work week is defined as forty (40) hours. <br />K. That effective July 4, 1983, all full-time sworn employees, with the ex- <br />ception of the Chief, the City of North Olmsted shall nay employees time and a half <br />1-1/2) their regular rate of pay for all hours required to be worked in excess of <br />tlie work day or week as defined in Paragraph J hereof. However, no emnloyee shall be <br />vaid at an overtime rate for time spent while pursuing educational endeavors, mandatory <br />schooling required by law or internal programs instituted by the Chief of Police re- <br />lating to changes in Revised Code or the Ohio Uniform Rules of Criminal Procedure. <br />It shall, however, be appropriate to pay the overtime rate to employees who participate <br />in specialt_y programs requiring training at times other than the employees' regular <br />tour of duty and further that said programs have been designated by the Chief of Police <br />as one for which the overtime rate will be paid. <br />L. Any employee who qualifies for overtime by virtue of the provisions of <br />Paragraphs J and K hereof shall be paid a minimum of two (2) hours when required to <br />report for extra duty over and above his regular work day and work week. Said employee <br />shall also be paid a minimum of two (2) hours for appearances at the Rocky. River <br />Municipal Court and a minimum of four (4) hours for appearances before the Grand Jury <br />or Common Pleas Court when the same is required and is at a time other than the <br />employee's regular work tour. The compensation for the aforesaid hours of credit will <br />be at a rate of time and one half (1-1/2) of the employees regular rate of pay. <br />M. Any time a Patrolman is required to temporarily take charge of a shift <br />command, said Patrolman shall be paid a premium of one additional hour at a straight <br />time rate for each day he is required to do so. <br />N. In the event that a full-time sworn employee of the Police Department of the <br />City of North Olmsted should be injured while in the line of duty due to a sudden and <br />accidental occurence and such injury has so incapacitated said member of the Police <br />Department that he is temporarily unable to work, then the Director of Public Safety, <br />after determining that said injury is work related and is of a temporary nature, may <br />authorize full payment of the employee's regular salary for a period of not more than <br />ninety days. If, after said ninety day period, said employee is still temporarily <br />incapacitated, then the Director of Public Safety shall recotmnend to Council whether <br />or not to continue said salary. Council shall forthwith review the matter and by <br />majority vote determine whether the employee shall continue to receive his full salary <br />during recuperation. <br />For the purnose of this paragraph, a sudden and accidental injury shall in- <br />clude such incidents as an automobile accident, assault and battery, ,un shot wound <br />and the like. It shall not be considered as sudden and accidental if in.jury or in- <br />capacity results from the lifting of objects, slipping, tripping or falling, heart <br />failure or heart attack.
