If the grievance is not resolved at <br />Step 4, the aggrieved employee shall submit <br />a written grievance to the Safety Director <br />within seven (7) working days following the <br />Chief's written response. The Safety <br />Director shall respond in writing to this <br />grievance within seven (7) working days of <br />its receipt. The requirements in Steps 2 <br />through 5 for written grievances and <br />responses shall not preclude the aggrieved employee or the Negotiating Committee and <br />the appropriate management representative <br />from orally discussing and resolving the <br />grievance. <br />6. If the grievance has not been resolved <br />at Step 5, the aggrieved employee shall <br />submit a written grievance to the Mayor <br />within seven (7) working days following the <br />Safety Director's written response. The <br />Mayor, or his designated representative, <br />shall reply in writing within ten (10) <br />working days thereafter, and that decision <br />shall be final and binding. <br />F. Workinq Da_ys. For the purpose of counting time, <br />"working days" as used in this ordinance will not include <br />scheduled days off, approved leaves or holidays. <br />G. Non-Discrimination. No member or official of the <br />Police Department shall be removed, disciplined, harassed or <br />discriminated against because he has filed or pursued a <br />-22-
