, .. • <br />grievance under this ordinance, except under the following <br />conditions. The Negotiating Committee shall have the right to <br />investigate and decide if the grievance brought before them is <br />a grievable item under the ordinance. If an employee is <br />repeatedly filing grievances and no bases are found for the <br />grievances, and the facts show these actions are disrupting or <br />impairing the operation of the Police Department or City, <br />disciplinary action may be taken against the employee. <br />ARTICLE XV LEGALITY <br />1. It is the intent of the City and the F.O.P. that <br />this Agreement comply in every respect with applicable legal <br />statutes and charter requirements. If it is determined that <br />any provision of this Agreement is in conflict with any court <br />of competent jurisdiction, that provision shall be null and <br />void and shall not affect the validity of the remaining <br />paragraphs of this Agreement. <br />2. Any past understanding, ordinance or resolution <br />which has been in effect shall remain in effect until such time <br />that it is modified by a subsequent agreement. Such <br />modification shall be completed by the procedures set up in <br />this Agreement for negotiations. <br />ARTICLE XVI <br />PER DIEM FOR SCHOOLING <br />Employees of the Police Department of the City of <br />North Olmsted shall be reimbursed, not to exceed Six and no/100 <br />Dollars ($6.00) per day, as per diem expenses while in <br />-23-
