, <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 84-41 <br />PAGE 2 <br />SECTION 2. PKIMARY ELECTIONS <br />On the first Tuesday after the first Monday in Iqay, in odd <br />numbered years, non-partisan primary elections shall be held for <br />the prupose of nominating persons as candidates for election to <br />offices to be voted for at the next succeeding general election. <br />SECTION 3, CERTIFICATE OF NOMINATION OR ELECTION CIRCUMSTANCES <br />(A) If in any odd numbered year no valid declaration of <br />candidacy is filed for nominations as a candidate for an election <br />to any office to be voted for at the regular municipal election <br />to be held in such year; or if the number of persons filing such <br />declaration of candidacy for nominations as candidates ror <br />election to such office does not exceed two (2) persons for all <br />elective offices except Council-at-large and for that office six <br />(6) persons, then no primary election shall be held for the <br />prupose of nominating candidates for election to offices to be <br />voted for at such regular municipal election, lhe election <br />official whose duty it would have been to provide for and conduct <br />the nolding of such prinary election shall declare the results <br />thereof and issue certificates of nomination to the persons <br />entitled thereto as if such primary election had been held and <br />shall declare each of such persons to be nominated, issue <br />appropriate certificates of nomination to each of them, and <br />certify their names to the proper election officials in order <br />that their names may be printed on the official ballots provided <br />for use in the next succeeding regular municipal election in the <br />same manner as though such prirnary election had been held and <br />such person had been nominated at such election. <br />(B) In the event there is only one valid declaration of <br />candidacy filed for nomination, as a candidate for election to <br />any office to be voted for at the regular municipal election to <br />be neld in such year or in the case of Council-at-large only <br />three (3) valid declarations of candidacy then, there shall be <br />rio primary election and the election official, whose duty it <br />would have been to provide for and conduct the holding of such <br />primary election, shall declare the results thereof and issue <br />certificates of election, to the persons entitled thereto, as if <br />such primary and general elections had been held and sha11 <br />declare each of such persons to be elected. <br />(C) If there are more than two (2) valid declarations of <br />candidacy filed for nominatioii as candidates for election to any <br />office to be voted for at the regular municipal election to be <br />held in such year or in tne case of Council-at-large more than <br />six (6) t.hen any candidate running in a primary election, as <br />specified in Section 2 of this Article, who receives, in the case <br />of all elective offices except Council-at-large, fifty five <br />percent (55I) plus one (1) vote of the total votes cast for that <br />office shall be e:lected to that office and a certificate of <br />election shall be issueci in the same rnanner as provided <br />in Section 3(B) hereof. In the case of Councilman-at-large any <br />person seeking that office in a primary election who receives <br />fifty five percent (55%) plus one (1) vote of the quotient of <br />the total number of valid votes cast for Council-at-large divided <br />by three (3) shall be elected to that office in accordance with <br />the provisions of this Charter and a certificate of election <br />shail be issued in the same manner as provided in Section 3(B) <br />hereof.
