, .• . <br />. . ? ± " "?•' .?,,. <br />. . . <br />(a) Late Charge. <br />The industrial waste surcharge levied shall be billed on the first <br />day of each calendar quarter, or as soon as such calendar quarter as <br />billing data becomes available, and shall be payable at the office of <br />the Director of Finance within thirty days after billing. In case of <br />failure to pay any bill for the surcharqe when due, a penalty of ten <br />percent per month of such charge shall be added to the bill. <br />(b) Delinquency; Lien. <br />Industrial waste surcharges levied in accordance with this Chapter <br />shall be a debt due the City and shall be a lien upon the property. <br />If this debt is not paid within thirty days after it is due aryd paya- <br />ble, it shall be deemed delinquent and may be recovered by civil <br />action in the name of the City against the property owner, the person <br />or both. <br />915.13 ADDITIONAL CHARGES BY AGREEMENT. <br />Over and above the rates and charges established by Section 915.04 <br />and 915.11 , there may be established in special instances and upon <br />special agreement between the City and the owner of any premises <br />served by the system, such additional charges for industrial wastes of <br />unusual strength or composition which are accepted by the City for <br />treatment as may be determined to be fair and equitable. Similarly, <br />rates supplemental to those established by Section 915.04 and 915.11 <br />may also be established by special agreement in any case not clearly <br />defined in such section or where satisfactory provision has been made <br />for direct measurement of the quantity of sewage discharged into the <br />system. Payment shall be praportionate to actual additional costs <br />incurred in treating or handling extra-strength wastes or unusual <br />discharges and in further conformity with this Chapter. Each such <br />special agreement and the charges established thereby shall not become <br />effective until ratified by a resolution duly passed by Council. <br />915.14 REMEDY OF CITY FOR NONPAYMENT. <br />Each sewer charge levied pursuant to this Chapter is hereby made a <br />lien upon the premises char9ed therewith and if the same is not paid <br />within ninety days after it is due and payable, it shall be certified <br />to the Auditor of Cuyahoga County who shall place the same on the tax <br />duplicate, with interest and penalties allowed by law to be collected <br />as other municipal taxes are collected. This section shall be in <br />addition to all other remedies provided by law. <br />915.15 DISCONTINLTP.NCE OF SERVICE; CHARGES. <br />In the event of failure to pay user charges or surcharges after <br />they become delinquent, the City shall have the right to discontinue <br />water service, or to remove or close sewer connections and enter upon <br />the property for accomplishing such purposes. <br />-8-
