Section 1: The City shall be the sole judge of the <br />necessity of overtime. All overtime shall be voluntary and an <br />employee shall have the right to refuse an overtime assignment <br />except for emergencies. An "emergency" is defined as any <br />impairment to City services or operations which cannot be delayed <br />until the beginning of the next regular work day. In non- <br />. emergency situations, the City may require the least senior <br />qualified employees in the classification who are available, to <br />perform the overtime work. <br />(a) Employees in the Service Department who are assigned <br />to leaf collection will work according to a weekly <br />pick-up schedule which schedule will include pick-up <br />and unloading of leaves, during the period from <br />November 1st to December 16th. In the event a crew <br />is not able to complete a daily route, employees <br />assigned to said route may be required to work up to <br />two (2) hours overtime. The City, however, agrees <br />that for purposes of overtime work, the same shall be <br />voluntary. Employees assigned to leaf collection will <br />have the opportunity to volunteer on a weekly basis. <br />If the volunteer .list consists of at least seventy- <br />five percent (75$) of those bargaining unit employees <br />needed to maintain five (5) leaf pick-up crews, then <br />in that event the same shall remain voluntary. If, <br />However, the seventy-five percent (75$) requirement <br />is not realized, then the City shall be free to revert <br />to the provisions in Section 2 of this Article. <br />18 <br />
