A. Scope. The following matters shall constitute a <br />.grievance within the system: <br />1. The interpretation or application of the matters con- <br />twined in this agreement; <br />2. Arbitrary, unreasonable or inconsistent working con- <br />ditions, and; <br />3. Unsafe or unhealthy working conditions. <br />B. Scope. The following matters shall not constitute a <br />grievance within the system: <br />1. The City Charter, State Code, Ordinance, <br />Personnel Policy or Departmental Regulations <br />pertaining to charging, investigating or disciplining <br />an employee for violation of a rule of conduct. <br />C. Representation/Class. A grievance that affects all <br />J) employees, or all employees of one rank or grade, or concerns <br />interpretation and/or application of the terms of this procedure, shall be <br />initially submitted to the elected officers within the North Olmsted <br />Police Department Negotiating Committee. <br />1. If the grievance is unresolved by the <br />Negotiating Committee, all relevant information, <br />including the written grievance and response, may be <br />submitted by the Negotiating Committee to the Chief of <br />Police within ten (10) working days of the Chairman <br />of the Negotiating Committee. <br /> 2. If the grievance is unresolved by the Chief of <br /> Police, the Negotiating Committee may, within ten <br />-14- <br />
